IMPORTANT NOTE: Prices are subject to change. Also, on occasion we have to make changes to this contract. If you have an approved puppy application, and have deposited, you do not have a grandfather clause and are subjected to any subsequent changes that are made after the Buyer (as defined below) has sent a deposit.

I. PREMIER DOODLES CONTRACT INFORMATION

**This Contract is for a Premier Doodles Puppy**
This contract is between Dr. Chris and Sharon Carmichael of Premier Doodles (name of breeder), hereinafter referred to as SELLER and our customer purchasing one of our puppies, hereinafter referred to as BUYER(s). Buyer is purchasing a bernedoodle puppy from Premier Doodles (SELLER) (Limited Registration as we do NOT allow our puppies to be used for breeding) for an agreed upon price via a texting offer for sale. Balance (price of puppy minus the $500 nonrefundable deposit) is due in full in cash at the time of pickup or by Zelle (use 330-324-3035) two weeks before pickup if this has not been paid yet (cash is preferred). If cash is not possible due to shipping being used (e.g. flight nanny) then use Zelle and if this is not possible then the form of payment must be agreed upon by the Seller at the time of puppy picks and all payments are to be made prior to picking up the puppy. Estimated Date of Pickup is 8 weeks after the birthdate of the litter. If the Buyer is unable to pickup the puppy on the designated due date, after being notified of the puppy pickup date, then the BUYER will forfeit the right to purchase the puppy but will remain on the master reservation list at their same spot they were at prior to puppy picks. If the BUYER conducts such action three times on three separate puppies they will then be removed from our master reservation list and the $500 deposit will be forfeited. Our pickup dates are firm and we do not keep puppies past the pickup date and will immediately find a new buyer from our reservation list. Once you are on the approved master reservation list, you will have 2 years to select a puppy or up until an offer has been made for the color and sex of puppy you indicated you had a preference for. We can not guarantee the timing of offers nor can we guarantee that your color and sex preference can be made. We can not guarantee that you will be a first or second puppy pick during the 2 years you are on the master reservation list. After 2 years if offered an opportunity for a puppy and declined, you will get one more opportunity for a puppy and if you pass again you will be removed from our master reservation list and will forfeit your deposit.
II. SHIPPING AND TRANSPORTATION:
PLEASE NOTE that the price of the puppy does not include any shipping and handling costs (this includes flight nanny and/or air travel costs). The options for shipping include: 1) using a flight nanny who meets our customers curbside at Arrival (we must preapprove all flight nannies and all pickups on our end MUST be at the Greenville-Spartanburg Airport (GSP) located in SC); or 2) BUYER flying into Greenville-Spartanburg Airport (GSP) to pickup their puppy (we would meet you curbside at Departure). You can also come to our home during an assigned puppy pickup date and time to pickup your puppy. A $100 surcharge is applied to the balance due if we have to travel to the Charlotte airport for delivery. The surcharge to deliver a puppy to the Atlanta aiport is $500. For those picking up their puppy at our home, the puppy will be brought to you in our driveway when you arrive and we will do all conversations outside weather permitting. This is to reduce the possibility of spread of parvo into our home due to the inadvertent transfer from shoes. We Wysiwash all paved areas after puppy pickup. You will have an assigned time to arrive and then just pull into our driveway and call either (330)324-3035 or (330)324-3036 and we will meet you outside.
III. BUYER CONDITIONS:
A. The Buyer agrees to provide a life-long commitment and a comfortable and safe environment. Buyer must have a secured fenced in backyard for playtime and potty time but not to be left there permanently. These are house dogs and they must remain in the house unless outside with their family. The Buyer agrees to provide prompt medical attention, proper grooming and responsible care. This includes keeping this Premier Bernedoodle puppy/dog parasite free and up to date with inoculations (only DHPP and Rabies), proper nutrition, which consists of a good quality professional feed given at regular intervals (we require that you use TLC Whole Life Adult/All-life-stages Food and orders can be made using the link on our website under Information Center, and feed 3-4 cups of food spread out over 3-4 feedings per day until 12 weeks old, and then dropped to 3 times per day, and eventually twice per day when 6 mos old), and fresh water available at all times. If puppy/dog seems to be still hungry after meal provide a little more until there is a little leftover. You are required to use TLC for a minimum of 12 months as part of this contract. If you choose not to use TLC after the first 12 months (unless there is a food-based allergy), you must select a high-quality food and one that is NOT GRAIN FREE AND that is preapproved otherwise this will null and void our health guarantee (and cannot contain corn, soy or wheat or legumes). Please have the Seller preapprove any alternate food. We will not approve any food that contains soy, corn or wheat or legumes or peas if it’s a top listed ingredient. If the puppy consumes all of their serving of food, then you may have to increase the amount of food per feeding time. Try to increase by a ¼ cup. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision and on a leash unless the owner is in a safe and secured area where some off-leash running can be done. Buyer can not use a tether system to tie up the dog for exercise and must have a fenced in backyard (or other arrangements preapproved by the Seller). The Seller will have each puppy micro-chipped via Fi Nano Microchip that the Buyer will receive registration information when they pick-up their puppy to facilitate his return if lost or stolen. The Seller requires (this is a mandate that if breached will also breach this contract and will result in immediate surrendering of puppy back to Chris and Sharon Carmichael of Premier Doodles) that this puppy NOT be chained up or kenneled outside and MUST be maintained in the home with the family with access to a fenced in or secure yard. Violation of this statement will result in the Buyer giving up their rights to the purchased Premier Bernedoodle and will not be reimbursed for payment made on such dog and will be removed from our Master Reservation List and forfeit both their deposit and money paid toward the puppy. Never should one of our puppies be placed into an outdoor kennel or chain or tether, and such actions will violate the terms and conditions of this contract. If any type of physical correction, such as whipping, hitting, electrical application, or any type of activity that causes physical and/or mental harm, is used on your Premier Bernedoodle the Seller will immediately take ownership of the puppy at the Buyer’s expense and money paid toward the puppy will be forfeited and Buyer removed from our Master Reservation List. We also do not allow the use of any type of traditional veterinarian prescribed flea, tick or heartworm medication for the first two years in order to get the health guarantee. Use of these products will void the health guarantee due to the growing FDA concerns about these products as it relates to causing neurological disorders, cancer, and cardiac and respiratory disorders. Please reach out to us for effective natural alternatives.
B. The Seller guarantees this puppy/dog to be of sound health and temperament at the time of this sale. A health record of all shots and/or worming will be provided by the Seller. The Buyer agrees to take this dog to a licensed veterinarian of their choice within 72 hours after picking up or having the puppy dropped off at your residence or other mutually agreed location, for a physical examination. The BUYER must sign up for the 30-day free pet insurance policy thru Trupanion using the information provided by the SELLER. This 30-day policy is part of our health warranty and Premier Doodles will not be responsible for veterinarian cost associated with the first 30-days if the BUYER fails to register their new puppy 24 hours prior to puppy pickup. NO VACCINATIONS are to be given during this first vet visit as we will have already given the first 8-week vaccination a day or two prior to puppy pickup. The second vaccination is due 4 weeks later at 12 weeks of age and will be the responsibility of the Buyer and the final puppy vaccination is due at 16 weeks and also the responsibility of the Buyer. Rabies vaccination must not be given prior to 16 weeks and no earlier than 20 weeks and should not be given at the same time as any other vaccinations. We only recommend DHPP during the puppy vaccinations at 12 and 16 weeks. We will provide our shot records to the Buyer which should be given to the licensed veterinarian at your first physical examination. If the vet recommends ANY repetition of puppy shots, or at an interval different than what is described above, PLEASE have the veterinarian call Dr. Chris Carmichael at 330-324-3035 (call or message) as THIS WILL CANCEL THIS GUARANTEE. Excessive vaccinations can be dangerous for them and should not be administered. Should puppy/dog be determined to be in ill health, the cause of which the Seller is clearly to blame, the dog may, upon a signed written diagnosis from said licensed veterinarian, be returned for a replacement puppy from a future litter that the Seller produces. The Seller assumes absolutely no responsibility for fees associated with caring for the puppy/dog. No other guarantees are given. Any required vaccinations or medical treatment after 8 weeks of age will be the responsibility of the Buyer. No puppy replacement or refund is provided in the event of death by Parvo (all puppies receive 1 Puppy Parvo vaccine during week 7-8). It is important to note that the puppy is not protected from Parvo until the complete set of parvo series are given (12 and 16 weeks). If you pick-up your puppy DO NOT use commonly used rest stops and other areas frequented by dogs as these are areas that often concentrate various diseases that can easily be transferred to the puppy and will void this guarantee. We recommend that their feet do not touch any ground until they get to your home. You can provide pee pads and the like inside your vehicle. The new Buyer must not take the puppy into public places until such a time that the parvo series have been given in full. The Seller will not be responsible for any veterinarian/medical costs at any time for the following, including, but not limited to, common conditions such as hernia (we will cover $100 of any cost associated with repair of a reducible umbilical hernia as this can be corrected at the time of spay/neuter; we make no other concessions nor financial contribution towards such repair nor cost of neutering or spaying and in most cases reducible umbilical hernias will self-repair), kennel cough, cherry eye, coccidiasis, parasites, giardiasis, uneven bites, worms nor hip or elbow dysplasia as we start with dogs that have been certified OFA and most forms of dysplasia in large fast growing breeds like a bernedoodle come from inappropriate physical activity (e.g. stairs, jumping, etc). The Seller has made all attempts to ensure a healthy and quality puppy, but cannot guarantee against any future health, dysplasia, or cancer conditions. In the event of death while in Seller's possession, Buyer's Paid Funds will be applied to a future puppy in a future litter or may be reimbursed at the Buyer’s discretion (the $500 deposit is nonrefundable however). Due to the variability of specialty hybrids (e.g bernedoodles), the Seller makes no guarantees about future temperament, size, markings, color change, coat quality, weight, longevity, health, conformation, or show potential. We start with Standard Poodles and Bernese Mountain Dogs that are champion quality dogs, with strong health records, and proven temperament, but beyond that we cannot make any expressed guarantees.

C. If within 2 years after the birthdate of this puppy, any defined genetic defects (to include vWD type 1, DM, and NE) are found through laboratory analysis, AND that will have an expressed deleterious effect on the livelihood of the dog, the puppy will be replaced with a puppy of equal value, whenever a puppy becomes available. Puppy will be replaced only when proof of genetic defect is diagnosed by a licensed veterinarian (a veterinarian’s opinion is not proof alone and genetic testing for a specific disease marker would have to be conducted by the Buyer and at their expense, along with the laboratory analytical results certified by the lab (this is done at the expense of the Buyer) in writing AND proof of spaying or neutering is given. The Buyer will retain the original puppy (we will discuss the option of placing the original puppy into a new home if that is what the Buyer prefers, but we will only facilitate this process which could include listing the availability of this puppy onto our website; however, the Buyer must have put their puppy through obedience training and the dog is well socialized and housebroken). If a replacement puppy is given, there is no additional replacement warranties made after the second puppy is given to the Buyer and the puppy is taken as-is with no additional health and/or replacement warranties. Joint issues, allergies, autoimmune disorder, or other conditions not stated above, ARE NOT covered by this warranty as they can be caused/induced by environmental factors such as over stressed joints prior to growth pates closing, diet, vaccination, medications (especially ongoing use of chemicals for flea/ticks/heartworm), pesticides used on lawns and in homes, etc. Please do your homework so you will be informed about how the overuse of vaccines and chemicals can affect your dog’s health.

D. The Buyers agree not to use this animal for breeding and agrees to have it spayed/neutered at the age recommended by Breeder (usually after the first heat in females and after 12 months of age and 16-18 months for boys, to allow for growth to finish in this large breed). Any breeding that is done with our Premier Bernedoodle puppies is a violation of our contract and will be subjected to a minimum of twelve thousand ($12,000) dollar additional fee if one of our F1 or F1B or F1bb Premier Bernedoodles (or other doodles, poodles or Bernese mountain dogs) are bred and will have to relinquish any litters as a result of breeding in violation of this contract. Buyer will be fully responsible for any deleterious defects due to breeding their Premier Bernedoodle to another dog.
E. Should any circumstances arise that affect the quality of life of the dog, the breeder/seller is to be informed so that they may participate in determining the future of the dog. The Breeder/ Seller reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or other facility. We only allow the transfer of our dogs to Seller approved families that are on our master reservation list. Any breach of this policy item will be subject to a twelve-thousand ($12,000) dollar penalty and must forfeit any current and future litters to Premier Doodles that result from using this puppy for breeding. We are always here to help you relocate your dog so please let us know first (you may call or text Dr. Carmichael at 330-324-3035) to see if we can exhaust all acceptable means. If we can help find a new home, and the new owner is willing to pay a fee, and the dog has been kept at the Buyer's home, all money transferred will go to the Buyer. If the dog has been transferred to the Seller, then the Seller will retain any money transferred from the third-party buyer.
F. The Buyer agrees to contact the Seller immediately if any questions or concerns arise about the dog, such as housing, diet, behavior, or health. The buyer agrees to keep the seller informed of any treatment as it occurs. This provides the Breeder/Seller with an opportunity to follow up on puppies and gives us important feedback and information on the health of our dogs for future generations. We would like the privilege of discussing how your puppy has been doing during the first year and will need a few minutes with the buyer to talk about all aspects of their dog experience. Ultimately, this helps us be the best and most responsible breeder we can be.
G. It is understood at the time of sale that this is a pet quality dog and it is representative of its breed. Training classes are highly recommended for a happy relationship between the dog and family however wait until after the puppy is fully vaccinated.
H. Due to the high demand for our puppies, and the need to maintain an updated list of serious buyers, we require a $500 non-refundable deposit. We cannot always guarantee certain color patterns (e.g. tricolor, black and white, merle, merle tricolor, phantom, etc.), nor gender, will be available at the time of your pick (first come/pay, first pick) nor can we can guarantee colors after you have been added to our list so please be mindful of this before you deposit. We have to make many decisions about which females we breed, for how long, and which future dams we are going to use for breeding where we first consider temperament, coat quality, and conformation and health and color is often not the primary consideration in our selection of future dams and sires for our breeding program.

I. The SELLER reserves the right to keep a puppy from each litter. No refunds are given as the deposit is non-refundable. We cannot guarantee litter sizes. We also cannot guarantee color/markings nor can we guarantee what the final color/pattern will look like in the adult. When a person pays a $500 reservation fee they understand this is nonrefundable and does not guarantee a certain color or gender in the puppies that become available. The BUYER will have 2 years from the original date of deposit to purchase a puppy from Premier Doodles otherwise they will lose their reservation fee and their place on the Premier Doodles master reservation list. We cannot guarantee timing of when puppies will become available nor can guarantee which dogs will be bred during the 2 year period.
J. Buyer agrees to use a crate for crate training to facilitate the house breaking process. The Buyer understands that puppyhood is both challenging and rewarding and that the Buyer must be patient through the process of house breaking and obedience training. We recommend that the puppy be in a crate when it cannot be closely watched, and that prior to placing in the crate the puppy is given an opportunity to relieve themselves outside. Also, as soon as the puppy is let out of the crate the puppy will be placed outside. Puppy should be let outside, under supervised conditions, following meals and drinking, and no less than once every 30 minutes (or more often) until week 12, after which the time in the crate can be lengthened (but again cannot live in the crate). Puppy must be afforded shade and clean water while outside and must be supervised. In extreme hot conditions (over 78F) the dog must be only let outside to relieve themselves and allowed the opportunity to come back inside in an air-conditioned home. The preceding paragraphs contain conditions established by the Seller to ensure the well-being of the puppy/dog. The Buyer’s agreements will continue for the duration of the dog’s life and the Seller will have the right to enforce the agreements. Our signatures below represent a legally binding agreement between the Buyer and Seller in accordance with the provisions set forth in this contract.
